Obtaining Dates and Booking Mediation
To inquire about Ramit’s mediation availability or fees, please email dates@mizrahilaw.com.
To book a mediation date, send an email to mediate@mizrahilaw.com with the following information, copying opposing counsel:
- Party names;
- Names and contact information for all counsel;
- A brief description of the case, including claims alleged;
- Whether the case is prelitigation or in litigation and, if the latter, case venue and number;
- Whether the mediation will be held by Zoom or in person (and desired location, if in person);
- Requested date;
- Requested start time (default is 10 a.m.; with Zoom mediations, we can begin earlier to accommodate participants in different time zones with agreement);
- Information on the agreed-upon fee split;
- If any participant is not fluent in English or has any accommodation needs, please notify us; and
- Confirmation that counsel have cleared the date with all key attendees (counsel, clients, adjusters) and agree to comply with the mediation procedures and the cancellation policy on this page.
Counsel for the other party/parties should then confirm that they have cleared the date with all key attendees (counsel, clients, adjusters) and that they agree to comply with the mediation procedures and the cancellation policy on this page.
Mediation Procedures
All parties must ensure that the appropriate decision makers, including the plaintiff, individual defendants, company decisionmaker(s), and any insurance representatives or other persons with full settlement authority or whose approval is necessary for resolution, attend the entire mediation on the scheduled date unless we have made other arrangements.
Mediation fees are due upon booking as invoiced.
Mediation briefs are due seven days before the mediation via email and must be submitted on time. Information about the requested contents of the briefs will be provided in the mediation scheduling letter.
Ramit conducts pre-mediation calls and will reach out to counsel to schedule them before the mediation.
For Zoom mediations, be sure to use a private, distraction-free space. If multiple attendees will be in a shared conference room, please ensure that each person is on a separate device.
When possible, defense counsel is encouraged to prepare and provide plaintiff’s counsel with a draft long-form settlement agreement with blanks for the monetary terms in advance of the mediation.
Cancellation Policy
The mediation fee will be refunded in full if the mediation is canceled at least 28 days before the scheduled date. If the mediation is canceled or delayed less than 28 days before the scheduled date, or a party fails to appear, the fee will be non-refundable, with counsel for the canceling/rescheduling/non-appearing party responsible for paying the full fee (including refunding any portion already paid by the non-canceling party), unless another matter is scheduled that day.
